Europe has long disfavored secondary sanctions as an instrument of sanctions policy. However, despite extensive criticisms that secondary sanctions can be overly-expansive, recent EU listing practice suggests a growing acceptance of secondary sanctions as a legitimate policy tool.
In a recent groundbreaking law review article, Jeff Nielsen, Jan Dunin-Wasowicz, and Gonzalo Saiz couch the wide berth of prototypical secondary sanctions and apply them in their proper scope to EU listing practice. In this way, they craft an entire substantive legal framework unique to the European Union: so-called ‘ancillary listings’.
The paper has been enthusiastically received in EU member states and by EU policymakers in Brussels alike. Join us for a discussion digging into the paper’s findings and arguments.
