Description:

Risks are rising that the US will impose secondary sanctions on non-US entities engaged in deals prohibited under US primary sanctions.

Non-US entities with business relationships in the US must comply with secondary issues. If they are in violation – and this includes import or export restrictions – they may be restricted partially or totally from participating in the US financial system. Non-US entities violating sanctions may find themselves on the Specially Designated Nationals and Blocked Persons (SDN) list.

For example, under the Iran Sanctions Act, the US Secretary of State or Secretary of the Treasury can impose on non-US persons ‘menu-based’ sanctions.

Various jurisdictions across the world have begun the process of implementing counter-sanctions measures, seeking to shield domestic companies from the extraterritorial reach of US secondary sanctions.

In this webinar we will discuss:

  • How US (secondary) sanctions affect non-US operators
  • The increased use of US secondary sanctions and export controls with examples of Executive Orders (EOs)
  • The collision of US secondary sanctions with other jurisdictions’ blocking sanctions
  • Establishing a legal position when rules conflict: best practices

During the webinar, participants will have the opportunity to contribute questions online.
