2020 Mid-Year Review: Anti-Bribery Enforcement and Compliance Trends

Last year saw several important corporate and sanctions compliance guidance documents released by regulators both in the U.S. and abroad.  Much of the advice had an emphasis on self-reporting, like the U.S. Department of Justice revisions to the Foreign Corrupt Practices Act or the U.S. Commodity Futures Trading Commission (CFTC) announcement that companies who self-report violations of the FCPA to the Commission may be spared civil monetary penalties.

In addition, the DOJ and the U.S. Office of Foreign Assets Control released detailed guidance on what elements the respective agencies expected to see in compliance programs. Both documents emphasized the importance of senior managements involvement in and commitment to compliance.

Europe also saw similar actions on the part of their regulators.  The U.K.’s Serious Fraud Office (SFO), released guidance on self-reporting violations and the French Anti-Corruption Agency released guidance on France’s version of a Deferred Prosecution Agreement.

As can sometimes be the case, with more clarification comes more expectations of adherence by regulators. This perhaps was foreshadowed by the increase in both OFAC penalties and FCPA-related fines last year.
